Website Services Terms
TERMS AND CONDITIONS
These terms and conditions (“Terms”) govern the provision of Website Design and Setup Services and Hosting and Maintenance Services by Signs Near Me Ltd (“We”, “Us”, “Our”) to our customers (“You”, “Your”).
1. Definitions
1.1 “Website Design and Setup Services” refers to the design and creation of a responsive WordPress website as per the chosen package, including particular features detailed within the package.
1.2 “Hosting and Maintenance Services” include website and email hosting, website maintenance such as speed optimisation and security measures, and daily backups.
1.3 “Website Edits” refers to any changes or updates to the website that extend beyond the agreed functionalities outlined in the Website Design and Setup Services.
1.4 “Plugins” are software components that enhance your website’s capabilities. Any additional plugins required for extended functionalities may incur extra costs.
2. Website Design and Setup Services
2.1 The Website Design and Setup Service is provided in accordance with the chosen package.
2.2 You are responsible for providing all necessary media and content required for the website design and setup. You must ensure that these are free from copyright infringements. We are not liable for any legal repercussions arising from copyright violations.
2.3 The payment for the Website Design and Setup Services is detailed in Section 4.
2.4 We reserve the right to adjust the cost for any additional functionalities or changes requested outside of the initial agreement.
2.5 We will provide basic templates for a website terms and conditions, privacy policy, and cookie policy based on your website requirements. We recommend seeking independent legal advice on these terms and policies. We will not be held liable for any incorrect legal statements. You must confirm in writing your approval of the wording before we make the website live.
3. Hosting and Maintenance Services
3.1 The Hosting and Maintenance Service is mandatory with any Website Design and Setup Service.
3.2 The service includes website and email hosting, licences for Elementor Pro and other premium plugins used for website functionality, daily backups, website speed optimisation, and security measures.
3.3 Your individual contract will detail the precise content of your package.
3.4 Extra costs may apply for additional storage, extra email addresses, or upgrades to Gmail.
3.5 We reserve the right to adjust the cost of Hosting and Maintenance Services after the initial 12-month contract period.
3.6 The payment for the Hosting and Maintenance Services is detailed in Section 4.
4. Website Edits
4.1 Any edits to the website beyond the agreed functionalities are not included in the Website Design and Setup Service and the Hosting and Maintenance Service.
4.2 Additional edits will be charged at our prevailing hourly rate and will be billed monthly alongside any hosting charges.
4.3 The cost of any additional plugins required for these edits will also be billed.
4.4 The payment for these edits and plugins is outlined in Section 5.
5. Payment
5.1 Payment for the Website Design and Setup Services is divided into three stages:
a. An initial 50% deposit before we commence work,
b. A 25% payment upon completion of the draft,
c. The final 25% payment when the website goes live.
5.2 Hosting and Maintenance Services will be invoiced monthly.
5.3 Website edits and any additional plugin costs will also be invoiced monthly.
5.4 All invoices must be paid by the due date specified on them.
5.5 Failure to pay by the due date may result in the termination of our services, which could impact the functionality of your website.
6. Termination
6.1 The contracts for Website Design and Setup Service and the Hosting and Maintenance Service can be terminated with a three-month written notice after the initial 12-month contract.
6.2 If you cancel our services, we will disconnect the premium plugins from our licence. This may impact their functionality with a new provider.
7. Complaints
7.1 If you have a complaint about our services, please contact us directly, so we can address your concerns promptly.
By using our services, you agree to abide by these terms and conditions.
